Folks who purchased certain Fitbit models at specific times are eligible for a payment of $12.50 as part of a class action settlement over falsely advertised features. Affected devices include the Fitbit Flex, Fitbit One, and Fitbit Ultra.
Plaintiffs in Brickman, et al. v. Fitbit claimed that their Fitbit devices weren’t able to track activity such as their steps and sleep in the same way that the company advertised on its product packaging. Although Fitbit denied the claim and maintained that the products worked as promised, a settlement was reached where members of the class action suit will be receiving $12.50.
You’re a member of the class action suit if you purchased a Fitbit Flex, Fitbit One, or Fitbit Ultra at the following times and locations:
- California or Florida from September 1, 2009 to October 27, 2014; or
- New York, Michigan, New Jersey, Pennsylvania, or Ohio from March 26, 2012 to October 27, 2014;
- Missouri or Illinois from March 26, 2013 to October 27, 2014; or
- Texas, Georgia, North Carolina, or Washington state from March 26, 2014 to October 27, 2014.
You must also have registered the device online for proof of purchase. To confirm if you’re eligible for the $12.50, you can visit SleepDeviceSettlement.com or call the settlement administrator toll free at 1-855-336-4163. This page has a form where you can begin filing a claim for your $12.50 slice of the settlement. Your claim form must be submitted or postmarked by December 22, 2019.
While $12.50 isn’t much of a payday, a free pizza is a free pizza. It’s also not as low as the $3.02 that one of Review Geek’s writers recently received from Sony over that time the company removed the ability to install Linux-based operating systems on the PlayStation 3 despite initially marketing the console with support for other operating systems.
